Simplification of Procedures with SICT

On July 2, 2025, the “Decree establishing simplification measures for procedures carried out with the Department of Infrastructure, Communications, and Transportation” (the “Decree”) was published in the Official Journal of the Federation. The Decree’s main purpose is to simplify, digitize, and reduce the processing times for procedures related to the freight transportation sector before the Department of Infrastructure, Communications, and Transportation (“SICT” for its Spanish acronym).

As part of the simplification, SICT merged and reduced the number of freight transportation procedures that can be carried out before said authority from almost 30 to 11. In addition, the Decree updated the requirements for each procedure, reducing the number of necessary documents and streamlining the filing processes for these procedures.

It should be noted that to obtain a permit for the federal motor carrier services of general cargo, the number of required documents was reduced to the following: i) online pre-registration; ii) documentation proving legal capacity (formation documents, powers of attorney, the representative’s identification, and registration with the SICT); iii) documentation evidencing legal ownership or possession of the vehicles; iv) civil liability insurance for damages to third parties; v) proof of payment for the procedure; and vi) a pollutant emission certificate, as well as a physical-mechanical conditions report (the latter for vehicles older than two years).

On the other hand, the documentary requirements for the permit for the operation and exploitation of the international motor carrier services of cargo were not affected, as they had already been modified last year, so these requirements were only confirmed in the Decree.

The Decree will enter into force five days after its publication; however, procedures submitted prior to the Decree’s publication will be resolved in accordance with the regulations in force at the time of its filing. Furthermore, the procedures outlined in the Decree will continue to be filed in original and copy forms for their verification, until SICT implements the tools for their digital processing.

Finally, it should be noted that the Decree repealed provisions of previous decrees that regulated these procedures, with the difference that the previous decrees used to mention the maximum deadlines for the resolution of the procedures, while the Decree does not mention any deadlines. Therefore, we must wait to confirm whether SICT determines these deadlines through another decree or if it includes them in the new procedures guidelines regulated in the Decree.
