Mexico Announces Phases to Reopen Construction, Mining, and Transportation Equipment Manufacturing Industries

On May 15, 2020, the Mexican Department of Health published a decree detailing the process for reopening the construction, mining, and transportation equipment manufacturing industries. Said decree amends a similar decree published in the Official Journal of the Federation the previous day.The target date for reopening these industries remains June 1, 2020. To be able to reopen, businesses operating in the such industries must comply with specific requirements during the following time periods:

  1. During the preparation period commencing May 18, businesses must prepare and present sanitary safety protocols in accordance with the general guidelines jointly issued by the Mexican Department of Health, the Mexican Department of the Economy, and the Mexican Department of Labor and Social Welfare. The protocols may be presented and approved concurrently with the preparations for reopening.
  2. During the time period between May 18 and June 1, 2020, sanitary safety protocols and mechanisms must be established at the workplace in accordance with the guidelines to be published by the above government agencies, and in conjunction with the Mexican Social Security Institute. If businesses complete the process and obtain approval prior to June 1, they may reopen early.

The decree states that businesses that do not comply with the sanitary safety protocols, and thereby put their employees at risk, will be closed down.The decree also provides that businesses in the automotive and auto parts industries that export products must comply with not only the sanitary safety protocols applicable in Mexico, but also those applicable in their countries of origin.Click here to read an English translation of the decree.Contact information:Joseph B.
